Terms and Conditions of Sale

By accessing or using Dingo Shipping Global (“DingoShip”, “we”, “us”, “our”) and/or purchasing products through our assisted purchasing and international forwarding services, you (“Customer”, “you”, “your”) agree to be bound by the following Terms and Conditions (“Terms”). These Terms constitute a legally binding agreement. Please review them carefully prior to using our services.

1. Nature of Service

1.1 Service Scope
DingoShip operates exclusively as an assisted purchasing and international forwarding intermediary. Under this service model:

• You authorise us to purchase goods on your behalf from independent third-party retailers, suppliers, or marketplaces (“Third-Party Sellers”).
• We facilitate the transaction, process payment, and arrange shipment to your nominated delivery address.
• DingoShip does not act as the seller, manufacturer, or distributor of the goods.

1.2 No Product Responsibility
As an intermediary:

• We do not design, manufacture, inspect, or test any products.
• We do not provide any assurances regarding product quality, compliance, safety, or fitness for purpose.
• We are not responsible for inaccuracies, defects, recalls, or misrepresentations made by Third-Party Sellers.

1.3 Limited Role
Our responsibilities are strictly limited to:

• Executing your purchasing instructions with reasonable care.
• Processing payments to Third-Party Sellers.
• Coordinating shipping and delivery to your specified address.

2. Product Quality, Warranties, and Liability

2.1 No Warranties
All products are supplied by Third-Party Sellers. To the fullest extent permitted by law, DingoShip disclaims all warranties, whether express or implied, including but not limited to:

• Merchantability, quality, or durability
• Fitness for a particular purpose
• Accuracy of product descriptions or compliance with local regulations

2.2 Third-Party Responsibility
All warranties, guarantees, and product-related obligations rest solely with the relevant Third-Party Seller or manufacturer.

2.3 Limitation of Liability
DingoShip shall not be liable for any loss, damage, injury, or expense arising from the use, misuse, or failure of any product. Our liability is strictly limited to losses directly attributable to our purchasing or forwarding services and will not exceed the total service fees paid for the relevant transaction.

3. Refunds and Returns

3.1 Product Returns
As DingoShip is not the seller of the goods:

• We do not accept returns, exchanges, or refunds for products.
• All product-related claims must be directed to the relevant Third-Party Seller in accordance with their policies.

3.2 Service Fees
Refunds of DingoShip service fees will only be issued where required by applicable law or where services have not been performed.

4. Orders, Payment, and Title

4.1 Order Accuracy
Orders are executed strictly based on the information you provide. You are responsible for ensuring all details are complete and accurate.

4.2 Ownership of Goods
Title to goods transfers directly from the Third-Party Seller to you at the point of purchase. DingoShip does not assume ownership at any stage.

4.3 Product Availability
All orders are subject to availability. If a product cannot be sourced, we will notify you and arrange a refund for that item, excluding any non-refundable service components already rendered.

4.4 Payment Terms
Full payment, including product cost, service fees, and estimated shipping charges, must be received prior to order processing.

5. Delivery and Risk

5.1 Delivery Estimates
Delivery timeframes are indicative only and not guaranteed. Delays may occur due to factors beyond our control, including courier operations, customs clearance, or external disruptions.

5.2 Transfer of Risk
Risk of loss or damage passes to you once the goods are dispatched or handed over to the shipping carrier.

5.3 Address Accuracy
You are responsible for providing a correct and complete delivery address. DingoShip is not liable for delivery failures resulting from inaccurate or incomplete information.

5.4 Compliance with Laws
You are solely responsible for ensuring that all goods ordered comply with import laws and regulations in your destination country. Prohibited or restricted items will not be shipped.

6. Customs, Duties, and Import Taxes

6.1 Importer of Record
For international shipments, you act as the Importer of Record and are responsible for:

• Payment of all applicable customs duties, taxes, and fees
• Compliance with local import regulations and documentation requirements

6.2 Exclusion of Charges
DingoShip does not collect or remit VAT, GST, customs duties, or similar charges. These are not included in our pricing and must be paid separately.

6.3 Customs Risks
We are not liable for delays, inspections, holds, confiscations, or additional costs imposed by customs authorities.

7. Limitation of Liability

To the maximum extent permitted by law:

• DingoShip is not liable for indirect, incidental, or consequential losses, including loss of profit, revenue, or business opportunity.
• Total liability for any claim shall not exceed the service fees paid for the affected order.
• Nothing in these Terms excludes rights that cannot be limited under applicable consumer protection laws.

8. General Provisions

• Prices are displayed in applicable currencies based on prevailing exchange rates and exclude taxes or duties unless stated otherwise.
• DingoShip reserves the right to refuse, cancel, or delay any order at its discretion, including in cases of suspected fraud or supply issues.
• Website content is provided in good faith but may contain inaccuracies; no guarantees are made regarding completeness or accuracy.
• These Terms constitute the entire agreement between you and DingoShip and supersede all prior communications.
• If any provision is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the jurisdiction in which DingoShip operates. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts or arbitration bodies within that jurisdiction, unless otherwise required by law.

10. Disclaimer

DingoShip acts solely as an independent purchasing and international forwarding intermediary.
We facilitate the acquisition and delivery of goods on your behalf but assume no responsibility for the products themselves, including their quality, legality, safety, or performance.
