Terms and Conditions of Sale

By using DingoShip (“DingoShip”, “we”, “us”, “our”) or purchasing products through our assisted buying and forwarding service, the purchaser (“Customer”, “you”, “your”) agrees to the following Terms and Conditions (“Terms”). Please read these Terms carefully before using our services.

1. Nature of Service

1.1 DingoShip provides an assisted purchasing and international forwarding service only. This means:

• You instruct us to purchase products on your behalf from third-party retailers, suppliers, or marketplaces (“Third-Party Sellers”).

• We facilitate the purchase, handle payment, and arrange shipment to your nominated address.

• DingoShip is not the manufacturer, retailer, or supplier of the products.

1.2 As such, DingoShip:

• Does not design, manufacture, or test products.

• Provides no guarantees or warranties regarding product quality, safety, legality, or suitability for any particular purpose.

• Is not responsible for product defects, recalls, failures, or misrepresentations by Third-Party Sellers.

1.3 Our responsibility is limited strictly to:

• Accurately executing your purchasing and forwarding instructions.

• Managing payments to the Third-Party Seller.

• Forwarding and shipping goods to your nominated address.

2. Product Quality, Warranties, and Liability

2.1 DingoShip makes no representations or warranties—express or implied—regarding any product purchased through our service, including but not limited to:

• Quality, performance, safety, or durability.

• Accuracy of description or compliance with local laws.

• Non-infringement of third-party rights.

2.2 To the fullest extent permitted by applicable law:

• All warranties, guarantees, or liabilities related to products rest solely with the Third-Party Seller or manufacturer.

• DingoShip is not responsible for losses, damages, injuries, or costs arising from product use or failure.

2.3 DingoShip’s liability is strictly limited to losses directly caused by our own services (purchase or forwarding). Under no circumstances will our liability exceed the service fees paid to DingoShip for the relevant order.

3. Refunds and Returns

3.1 Because DingoShip is not the seller or manufacturer of the products:

• We cannot accept product returns, exchanges, or refunds.

• Any return, refund, or warranty claim must be directed to the Third-Party Seller or manufacturer, in accordance with their policies.

3.2 Refunds for DingoShip’s service fees will only be provided where required under applicable law or in cases where we fail to perform the forwarding service.

4. Orders, Payment, and Title

4.1 Orders are carried out strictly based on your provided instructions. DingoShip is not responsible for delays, losses, or issues resulting from inaccurate or incomplete instructions.

4.2 Title (ownership) of the goods transfers directly from the Third-Party Seller to you. DingoShip does not take ownership of the products at any point.

4.3 Orders are subject to product availability. If a product is unavailable, we will notify you and issue a refund for that product (excluding service fees already rendered).

4.4 Full payment must be received before any order is placed or shipment processed.

5. Delivery and Risk

5.1 Delivery estimates are provided in good faith but are not guaranteed. DingoShip is not liable for delays caused by couriers, customs, weather conditions, strikes, or other circumstances beyond our control.

5.2 Risk in the goods passes to you once the items are dispatched or handed over to the shipping carrier.

5.3 You are responsible for providing a complete and accurate delivery address. DingoShip is not liable for lost or undeliverable shipments caused by incorrect or incomplete information.

5.4 You are responsible for ensuring the legality of all imported goods in your destination country. DingoShip does not ship prohibited or restricted items under international shipping laws.

6. Customs, Duties, and Import Taxes

6.1 For international shipments, you are considered the Importer of Record and are responsible for:

• Paying all customs duties, import taxes, clearance fees, and brokerage charges.

• Complying with all import laws and regulations in your destination country.

6.2 DingoShip does not collect or remit Goods and Services Tax (GST), Value-Added Tax (VAT), customs duties, or any other government-imposed import charges.

6.3 Customs duties and import taxes are not included in DingoShip’s service fees. These charges must be paid by you directly to the carrier or relevant authority prior to delivery.

6.4 DingoShip is not liable for customs delays, detentions, seizures, confiscations, or additional costs imposed by customs or border control agencies.

7. Limitation of Liability

To the fullest extent permitted by applicable law:

• DingoShip is not liable for any indirect, incidental, or consequential loss, including loss of profit, revenue, or opportunity.

• Our total liability for any claim related to your use of our service shall not exceed the total service fees paid for the affected order.

• Nothing in these Terms limits your rights under applicable consumer protection laws that cannot be excluded.

8. General Provisions

8.1 All prices are stated in Australian Dollars (AUD) unless otherwise indicated and exclude applicable taxes or duties.
8.2 DingoShip reserves the right to cancel, reject, or delay any order at its discretion, including for suspected fraud, payment issues, or product unavailability.
8.3 All information on our website is provided in good faith but may contain errors. DingoShip does not warrant the completeness or accuracy of any content.
8.4 These Terms represent the entire agreement between you and DingoShip regarding your use of our services and supersede any prior understandings or communications.
8.5 If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue in full effect.

9. Governing Law and Jurisdiction

These Terms are governed by the laws applicable in the jurisdiction where DingoShip is registered and operates, without regard to conflict-of-law principles.
You agree that any dispute, claim, or legal action arising from or relating to these Terms or our services will be resolved exclusively through competent courts or arbitration in that jurisdiction, unless otherwise required by applicable law.

10. Disclaimer

DingoShip acts solely as an independent purchasing and forwarding intermediary.
We assist you in buying and shipping products internationally upon your request.
We are not responsible for the quality, legality, safety, or performance of those goods.
